MINUTES
Regular Meeting of April 14, 2010 at 7:30 pm
Newtown Municipal Center, 3 Primrose Street, Newtown, CT

PENDING APPLICATIONS

Mod #03-54   72 Hanover Road, R. Mastroni Developers, LLC. Application related to the modification of an existing permit.

Alan Shepard, from Nowakowski, O'Bymachow & Kane, 415 Howe Avenue in Shelton, was present along with Mr. Mastroni, to provide an update on work being accomplished.  They were asked about the stabilization of the ledge.  It was noted that they need to wait for the area to dry up before placing machinery on top of the ledge and will work on the ledge water issue as soon as they can.  The commission asked for a plan of this work, a construction sequence, and a schedule for completion.

Mod #06-37   42 Alpine Circle, Louis Segneri. Application related to the modification of an existing permit application.

Alan Shepard, Jim McManus from JMM Wetlands Consulting, and Mr. Segneri were present to discuss the application.  Mr. McManus reviewed his letter of March 24, 2010 and stated he believes there would be less impact to the wetlands with a box culvert.  He said the best scenario would be to have a shared driveway but with the disapproval of other commissions, it requires the crossing of the wetlands.  The commission asked if they plan to mitigate the area with plantings.  Mr. McManus described shrubs that can be planted.  They were asked if the stream restoration under the box culvert could be supervised.  Mr. McManus stated he would supervise the work.

Commissioner Salling motioned to approve the application with standard conditions A, B, C, D, E, F, L, and
  • The approved plans are “Map of Property, Lot 138 Riverside Subdivision – Section J,” dated November 20, 2009 for Louis R. Segneri, 42 Alpine Circle, Newtown and
  • Quarterly reports will be submitted on forms provided on the Town of Newtown website or in the Land Use office until the permitted activity is complete.  The completed plan will be approved by the Conservation Official, and
  • Downstream mitigation and planting plan to be approved by staff, and
  • Culvert construction to be done under the supervision of a qualified environmental restoration specialist.
Commissioner Pieragostini seconded the motion.  Motion approved unanimously.

Mod #05-19   224 South Main Street, Robert Mastroni.  Application related to the modification of an existing permit application.

Alan Shepard and Mr. Mastroni were present to discuss the application.  Mr. Shepard reviewed their plans and responded to the commission’s expert report.  The commission will review the material.  The applicant submitted a request for extension.    

IW #10-02   41 Mohawk Trail, Westchester Modular Homes of Fairfield County.  Application to replace
existing home with a modular home.

Joe Enright and David Dillman from Westchester Modular Homes of Fairfield County, 4 Stony Hill, Bethel, were present and distributed a cross section view and construction sequence as requested by the commission.

Commissioner Pieragostini motioned to approve the application with standard conditions A, B, C, D, E, F, and
  • The approved plans are “B100A Code Compliance Septic Plan” for 41 Mohawk Trail, Newtown, dated 1/19/10, by Michael Mazzucco, P.C., and
  • Quarterly reports will be submitted on forms provided on the Town of Newtown website or in the Land Use office until the permitted activity is completed.  The completed plan will be approved by the Conservation Official.
Commissioner Kotch seconded the motion.  Motion approved unanimously.

IW #10-03   Warner Pond Dam (Old Mill Road) Town of Newtown.  Rehabilitation of an existing deficient dam as ordered by the DEP.

Ron Bolmer, Town Engineer, 4 Turkey Hill Road in Newtown, was present to explain plans to replace a dam as ordered by the DEP.  The commissioners will walk the site.  Mr. Bolmer will return to the next meeting.

IW #10-04  Housatonic Railroad Company, 30 Hawleyville Road.  Activities related to the operations associated with a rail yard transfer station.

Acceptance of New Applications

Approval of Minutes: Commissioner Pieragostini motioned to approve the minutes of March 24, 2010.  Motion seconded by Commissioner Salling.  Motion carried unanimously

Adjournment:  Commissioner Pieragostini motioned to adjourn the meeting at 9:55 pm.  Motion seconded by Commissioner Kotch.  Motion carried unanimously.
